Whistleblower Policy

Objective

This policy aims to protect employees and personnel who report misconduct at NDU. It outlines the process for reporting concerns and ensures confidentiality and protection for whistleblowers.

Scope

This policy applies to reports of misconduct, including but not limited to:
  • Breaches of NDU policies and procedures
  • Discrimination based on gender, color, religion, or nationality
  • Contract breaches, fraud, or violations of laws or regulations
  • Sexual harassment
  • Verbal or physical abuse, including bullying or nepotism
  • Endangering the health or property of NDU or its employees
  • Illegal activities
  • Attempts to conceal evidence of misconduct

Reporting Misconduct

  • Employees should feel comfortable discussing concerns with their direct manager or the Director of HR.
  • If the concern involves the manager, or if the employee is unsatisfied with the response, they should escalate the matter to higher administration.
  • NDU management must notify the Director of HR of any allegations related to this policy and provide supporting materials.
  • A whistleblower is any NDU employee or personnel who suspects misconduct or illegal activity.
  • The identity of the whistleblower will remain anonymous unless they agree to disclosure.
  • The receiving unit or department must ensure that the whistleblower is not subjected to harassment or retaliation.
  • If a report is made in good faith and under a reasonable belief, but is not substantiated, the reporter will not be held liable. However, malicious or frivolous reports may result in disciplinary action.

Validation and Investigation

  • The Director of HR is responsible for validating the accusation and, if necessary, consulting with legal counsel.
  • The Director of HR will escalate the matter to the President, except for complaints against the Director of HR, which will be submitted directly to the President's Office.
  • The President will form a committee to investigate the matter confidentially.
  • The investigation results will lead to appropriate actions and potential procedural amendments.

Confidentiality and Protection

  • NDU will maintain the confidentiality of whistleblowers and protect them from retaliation.
  • Individuals who believe they have been retaliated against may report the matter to the Director of HR.
  • The identity of a whistleblower may be disclosed only with their consent or when required by law.
  • The accused individual has the right to access relevant information.

Exceptions

Exceptions to this policy must be approved by the University Council.

Authorization

This policy is authorized by the University Council and the Board of Trustees.

Breach of Policy

  • Any employee or personnel who fails to comply with this policy may face disciplinary action, including dismissal.
  • NDU reserves the right to terminate relationships with individuals or organizations that breach this policy.
